Tenders. Many entrepreneurs see it as an impenetrable jungle of rules.
According to procurement expert Irene Boon, that is a shame, because the government can be an interesting client.
I am journalist Margreet Reintjes and in this podcast I am updated by her about all the myths and facts.
Welkom bij De Overheid als Klant.
Welcome to The Government as a Customer.
In this episode, we are going to talk about the situation where you did not win the tender.
Balen, wat te doen. Maar we beginnen met een fabel.
Bummer, what to do. But we start with a fable.
Yes, I would actually like to link this to a somewhat tragic fact.
The story goes that you cannot win against the government if you file a procedure about it.
Because that is actually the way to contest an unawarded tender.
And then you hope it's not true, but there are now studies that have emerged indicating that in a small eighty,
In 80% of cases, the contracting authority wins a lawsuit.
So yes, that certainly discourages you to incur all those costs and put in all that effort.
Apart from the fact that many entrepreneurs are still afraid that they will be viewed in a bad light if they initiate such a lawsuit.
So yes, that fact actually belongs in this episode.
Yes, in short, a fable that proves to be a fact.
Ja, ja, helaas wel. Ja, helaas wel.
Yes, yes, unfortunately so. Yes, unfortunately so.
Maar wat te doen. Je hebt verloren.
But what to do. You have lost.
Well, the very first thing that happens when you find out that you haven't won it,
dan krijg je een voorlopige gunningsbeslissing.
then you will receive a provisional award decision.
And it states that we intend not to grant you, words to that effect.
And the very first important thing is that you carefully check whether the motivation for that,
so the justification for why that is, or whether it is in order.
Ja.
Yes.
En waar moet die dan aan voldoen?
And what should it meet?
Well, you should be able to deduce from that whether you are right.
Bent afgewezen voor deze opdracht.
You have been rejected for this assignment.
Or that you rightfully received a lower score than someone else.
So a note saying, you didn't get it because someone else did, is not enough.
So the first important thing is to really look at which points I have scored.
En hoe is mijn kwalitatieve inschrijving beoordeeld?
And how has my qualitative application been evaluated?
Because you get it back as a sort of paper with red pen marks saying, "not enough points here?"
No, you used to get a note.
I am sending a message with an attachment, and it simply describes the rationale for this decision.
So you don't get your own registration back, but you actually receive a kind of report.
But you can see that in question 1 I only scored three points, and that is for D&D reasons.
Yes, and what is very important is that the framework within which it is assessed,
that the contracting authority has complied with that.
Ja.
Yes.
a decision and then they say well we didn't find it surprising at all, yes that is not correct,
because they would evaluate it based on the degree to which it was innovative, and that is not the same.
as surprising. This is also why you should always ask a question if the evaluation framework is not
duidelijk is.
is clear. Very often you see when you go to register a certain formula where you how they
Going to calculate that you are going to win such an assignment and then it says you score a 6 if you do enough.
you get an 8 if you already meet our expectations and you score a 10 if it is excellent.
is.
is. When you read that you think okay, it’s just like school, we are back in the school desks again.
Alright, then you will register, and unfortunately you won't be awarded the assignment, and then it says
Your registration was not satisfactory; it met expectations but not more than that, and then I am.
you're really angry. Then you think I really wrote an excellent story, why not, but then you have none.
houvast om te zeggen.
a basis to say.
Yes, it is not correct how you have assessed it. While if you during that ongoing
The procedure asks a question about yes but what is your expectation and what should I do to achieve that.
exceeding expectations. I need to focus closely on the quality measures we implement.
In our company, or should I focus more on, well, innovation. Then you can be much more targeted.
register and then you can also check much better whether the assessment is according to that
That has taken place. So that's actually the first thing you need to do. Important to know.
Is that the assignment is always first provisionally awarded and then a period of 20 goes into effect?
calendar days within which you can still object to that provisional decision. And that period has
you as a registrant to determine yes or no whether it makes sense to take action or not. So that
The justification for that decision must contain a lot of information.
Nou ja niks menselijks is ons
That you can make a consideration whether you think it is justified or not. Well, nothing human is alien to us.
All strange, so you will find 9 out of 10 times that it is really ridiculous that you do not get that assignment.
hebt.
you have. But well, then you can discuss with a lawyer to see if they agree. And if you think
Dus
that if you really have a good reason to dispute that, it must be done within those 20 days. So
that deadline is quite short. But that deadline will only start when the motivation is complete.
did not win the assignment because we are going to give it to someone else because we found that more enjoyable
or better, so to speak. And if there is nothing substantive in it, then that is not a valid
award decision and then that ALCA period will not start running. So it will only commence on the
The moment you really get the information you need to make the decision, I will accept it.
Or am I going to contest this after all. But it is quite debatable whether it is a sufficient answer or not?
Yes, there is a lot of case law about that, but the simple rule is that you just have to base it on...
that decision that weighing can be made so all information must be included. So you have to ensure
that you always have a copy of your own registration so you can see what you have as well
weer precies geantwoord? Zeker ja. En wat zeggen zij hierover? Ja en ook het beoordelingskader goed
Answered exactly again? Certainly. And what do they say about this? Yes, and also the assessment framework is good.
keep to see if it has indeed been assessed in that way. So you can file an objection.
at the moment you disagree. And what else can you do? Well, there are various
ways to do that. You can file a complaint with the contracting authority itself. You can file a complaint
indienen bij de commissie van aanbestedingsexperts. Daar hoef je niet voor te betalen. Maar dat advies
submit to the commission of procurement experts. You don't have to pay for that. But that advice
is then not binding again. So yes, that's always a bit of a disadvantage. Yes, you don't get anything out of it.
dus uiteindelijk?
So in the end? Well, if the contracting authority says okay, this committee is so authoritative.
We listen to it and you know, we adapt well. But you should do that in advance.
neerleggen.
laying down. With that, you can't force anything. And of course, you can do that if you have a summary proceeding.
start.
start. And then you just go to the court. Can you know in advance if they are going to comply?
laying down such a commission decision? No, they may decide that themselves and it is up to them. The
The thought is that the committee is so authoritative that it actually does not allow for it.
to lay down next to you. But in practice, you do see that it happens. And that can happen with
a court ruling not. But well, there are costs associated with that again.
So those variants are there. But I just heard the fable that ultimately turns out to be a fact.
Litigation does happen, but in very limited cases does it lead to victory. Yes, I think it does not.
zo zwart wit is.
It's so black and white. Of course, it sounds that way when the government wins 80% of the cases.
dat je dus eigenlijk kansloos bent. Dat is denk ik niet waar. Het hangt natuurlijk ook
that you are actually hopeless. I don't think that's true. It also depends, of course
depending on the quality of the claim being made. And what is usually the case is that the government
meespeelt is dat zo'n rechter kijkt in kort geding. Dus dat is altijd een beperkte
What plays a role is that such a judge looks in a summary proceedings. So that is always a limited
toets.
test. And then it may also be that you are indeed right, but that it is generally
the interest that the government serves should weigh more heavily than the interest of the bidder. And
that is always tricky when litigating against the government. So you are certainly not out of luck. I
wouldn't it also discourage someone from starting such a procedure if you truly think that
It's a long shot. So you really need to have a specialized lawyer and not your corporate lawyer.
"that can also read the procurement law a bit and have something like that done because then it goes"
it actually goes irrevocably wrong. And if you as an entrepreneur just feel incredibly frustrated
but you really don’t feel like a huge lawsuit. What can you do then? Well then you can
You can always request a conversation with the contracting authority in which you want to find out why they
vinden dat jij niet gewonnen hebt. Ja maar dat staat er toch?
think that you haven’t won. Yes, but doesn’t it say that?
Yes, but that conversation there you can get an explanation about. You need to do that in the
So make sure to do this within that 20-day standstill period. Because from that conversation you then
information you can still use in your lawsuit. But if the situation arises
what you're describing now. That you're saying well I'm not going to court at all and I
don't go to the committee either and I absolutely don't want that to become a complaint, but I want

do it. Can you also request such a conversation? But then I would always advise you to

service. If you come within the standstill period, especially if you bring a lawyer.

You say that I'm not going to do that. Then let that be known to that contracting authority as well.
Zeg dan.
Say it then.
Ja we willen ervan studeren.
Yes, we want to study it. We don't want to make it into a bigger task. But we want to
Want we begrijpen

not sincerely.
Ja we willen ervan leren.
Yes, we want to learn from it.

Does that work for you? And as far as we are concerned, that can be after the approved deadline.

Ja stel dus een goede vraag. Stel als het beoordelingskader niet duidelijk is. Stel een
