En opeens komen die andere verdachten in beeld en zijn er.

And suddenly those other suspects come into view and are there.

Nou ja, dat was natuurlijk een grote verrassing.

Well, that was certainly a big surprise.

En dan denk je ook even van ja, heeft het dan nu nog zin om dat te doen?

And then you also think, yes, does it still make sense to do that now?

Nou ja, soms als je ergens aan begint.

Wat voor indruk kreeg jij van de verdachten?

We begonnen de ochtend met twee van de uitvoerders, als ik maar zo even mag zeggen.

We started the morning with two of the performers, if I may put it that way.

Dus de mensen die daadwerkelijk in Nederland waren geweest om de duiven te stelen.

So the people who had actually been in the Netherlands to steal the pigeons.

Waarvan eentje stellig ontkende dat hij erbij was geweest.

Of which one categorically denied that he had been there.

Terwijl het bewijs, nou ons idee, er echt wel heel dik in zat.

While the evidence, well our idea, was really very strong.

Hij werd ook kritisch ondervraagd door de rechtbank en door mijzelf.

He was also critically questioned by the court and by myself.

En de andere verdachten, die bekenden wel.

And the other suspects did confess.

Dat had hij min of meer ook al wel gedaan bij de politie.

He had more or less already done that with the police.

Maar dat herhaalde hij nu wel op zitting.

But he did repeat that in court now.

Je moet je ook voorstellen, zo'n gesprek met die verdachten, daar zit ook een tolk bij.

You also have to imagine, in such a conversation with those suspects, there is also an interpreter present.

Het zijn natuurlijk mensen uit Litouw, die de Nederlandse taal niet machtig zijn.

They are of course people from Lithuania who are not proficient in the Dutch language.

Dus die tolk was ook die dag, want ochtends twee verdachten en in de middag ook nog twee.

So that interpreter was also there that day, because in the morning there were two suspects and in the afternoon also two more.

Dus die was de hele dag aan het vertalen en simultaan vaak.

So she was translating all day long and often simultaneously.

Dus ja, het was een bijzondere dag, omdat het een bijzondere zaak was natuurlijk.

So yes, it was a special day because it was a special case, of course.

Er was ook media-aandacht voor geweest en er zaten ook schrijvende pers in de zaal.

There was also media attention for it and there were also journalists in the audience.

En ja, de indruk die ik van de verdachten heb gekregen, wat ik al zei, wisselend.

And yes, the impression I've gotten of the suspects, as I already mentioned, is varied.

En ik denk uiteindelijk, als je in die end kijkt, hebben de drie van de vier bekend.

And I think ultimately, when you look in the end, three out of the four have confessed.

Dat ze erbij betrokken zijn geweest en eentje stellig niet.

That they were involved and one certainly was not.

Het OM eist één keer negen maanden en twee keer tien maanden gevangenisstraf.

The Public Prosecution Service is demanding one sentence of nine months and two sentences of ten months in prison.

En het legt de procesafspraken met de vierde verdachte, de aanstuurder van de andere drie, voor aan de rechtbank.

And it presents the procedural agreements with the fourth suspect, the mastermind behind the other three, to the court.

En daar moeten ze dus iets in.

And they have to do something about it.

Wat voor het OM van belang is.

What is important for the Public Prosecution Service.

En er zit iets in wat voor de verdediging van belang is.

And there is something in it that is important for the defense.

En voor het OM was van belang dat we de verdachte in voorlopige rechtenis konden houden.

And for the Public Prosecution Service, it was important that we could keep the suspect in pre-trial detention.

En dat we een forse gevangenisstraf zouden willen eisen.

And that we would want to demand a substantial prison sentence.

Omdat we dit een ernstig feit vinden.

Because we consider this a serious matter.

En we hebben dus afgesproken dat het een gevangenisstraf zou eisen van twaalf maanden.

And we have therefore agreed that it would require a prison sentence of twelve months.

En voor de verdediging was het van belang dat...

And for the defense, it was important that...

Dat de verdachte zo snel mogelijk weer naar Litouwen kon.

That the suspect could return to Lithuania as soon as possible.

Daar eventueel ook de straf zou kunnen uitzitten.

There it could possibly serve the sentence as well.

En dat hij ook niet nog een ontneming aan zijn broek zou krijgen.

And that he wouldn't be faced with another confiscation either.

Of in één keer allerlei...

Or all at once...

Of meer andere feiten op de terlastenlegging zou krijgen.

Or would receive more other facts regarding the indictment.

Want je zou ook kunnen denken aan deelname aan een criminele organisatie.

Maar hij wilde het zo beperkt mogelijk houden.

But he wanted to keep it as limited as possible.

En zo hebben we dat dus afgesproken.

And so we agreed on that.

Dat er alleen vervolgd wordt voor gekwalificeerd...

That there is only prosecution for qualified...

Een diefstal, geen ontneming.

A theft, not an appropriation.

En dat het OM kenbaar maakt dat we ermee kunnen leven als ijzerstraf in Litouwen verder uitzit.

And that the Public Prosecution Service makes it clear that we can live with the fact that the iron punishment is further served in Lithuania.

De rechtbank ging gisteren 13 juli 2023 akkoord met deze procesafspraken.

The court agreed to these procedural agreements yesterday, July 13, 2023.

De passeradebanger is er blij mee.

The passer-by is happy with it.

Strafrecht werkt vooral als het kort op de gepleegde feiten zit.

Criminal law works best when it is closely related to the committed offenses.

En de logistiek van ons strafproces.

And the logistics of our criminal process.

De partijen, de werkdruk van alle betrokken mensen.

The parties, the workload of all involved people.

De ingewikkeldheid van de zaken.

The complexity of the matters.

Maken dat het echt steeds moeilijker wordt om zaken binnen afzienbare termijn...

Making it increasingly difficult to get things done in a reasonable timeframe...

Na het plegen van dat strafbare feit op zitting te krijgen.

To be brought to court after committing that crime.

En er een vonnis in te krijgen.

And to get a judgment on it.

Dus we zijn eigenlijk met z'n allen steeds op zoek naar hoe kunnen we dat nou versnellen.

So we are actually all constantly looking for how we can accelerate that.

Hoe kunnen we dichter op het strafbare feit de strafzaak afdoen.

How can we handle the criminal case closer to the offense?

En dit is dus een manier die we met elkaar aan het verkennen zijn.

And this is a way that we are exploring together.

Kan dit ook werken?

Can this work too?

Als de verdediging en het OM het er al over eens zijn...

If the defense and the public prosecution already agree on it...

Dat dit zo zou moeten.

That it should be like this.

Heeft de rechtbank dan minder tijd nodig om de zaak te behandelen?

Kan de rechtbank dat dan overnemen?

Nou in dit geval hebben ze dat gedaan.

Well, in this case, they did that.

Dat is voor de eerste keer in Noord-Nederland.

En dat is dus een goede stimulans om...

And that is therefore a good incentive to...

Nou het geeft ons richting.
