Das hat schon, glaube ich, das war, glaube ich, in dieser Hinsicht wirklich eine Zäsur.

I think that was really a turning point in this regard.

Marco Overhaus ist Wissenschaftler in der Forschungsgruppe Amerika bei der Stiftung Wissenschaft und Politik.

Marco Overhaus is a researcher in the America research group at the German Institute for International and Security Affairs.

Er forscht unter anderem dazu, wie stabil die Demokratie in den USA ist.

He is researching, among other things, how stable democracy is in the United States.

Das Problem, das wir eben heute auch noch haben, ist, dass die Ereignisse von damals und auch die politischen Folgen bislang nicht wirklich aufgearbeitet worden sind.

The problem we are still facing today is that the events of that time and their political consequences have not really been addressed.

Insbesondere nicht von den Parteien.

In particular, not from the parties.

Nein, überparteilich im amerikanischen Kongress.

No, nonpartisan in the American Congress.

Und insofern, ja, diese fehlende Aufarbeitung auch dazu beigetragen hat, dass die Vergiftung, die damals eben auch passiert ist,

Nicht alle RepublikanerInnen finden das gut.

Liz Cheney zum Beispiel gilt als schärfste parteiinterne Kritikerin von Donald Trump.

Sie sieht die Demokratie durch Trump gefährdet und sagt, sein erneuter Wahlsieg wäre das Ende der Republik.

She sees democracy endangered by Trump and says his reelection would be the end of the republic.

Sie sagt, wenn er gewählt wird, ist es nicht so gefährlich, weil wir alle diese Rechnungen und Bindungen haben.

She says that if he is elected, it is not so dangerous because we all have these invoices and obligations.

Aber erstens ist das schon schlimm genug und zweitens, wie sehr kann man Trump überhaupt noch trauen?

Also zum einen würde ich mal sagen, die politischen oder die Probleme der amerikanischen Demokratie, also die Delegitimierung von Wahlen,

auch der Kontrollverlust des Kongresses eigentlich als Kontrollinstanz des Weißen Hauses, der exekutive Politisierung der Justiz.

Und es würde auch nicht sofort am nächsten Tag, wenn Donald Trump die Wahlen noch mal gewinnt, zum Zusammenbruch der US-Demokratie führen.

Aber ich denke schon, dass wenn Donald Trump noch mal ins Weiße Haus einzieht,

Und wie stabil ist die Demokratie heute?

Dass es immer noch auch sozusagen viel Widerstand gibt gegen Versuche,

That there is still, so to speak, a lot of resistance against attempts,

die amerikanische Demokratie zu entkernen und die auf die oft zitierten Selbstteilungskräfte der amerikanischen Demokratie setzen.

to hollow out American democracy and rely on the often-cited self-dividing forces of American democracy.

Insofern, ich bin auch kein Prophet, ich kann auch nicht einschätzen, ab welchem Punkt es wirklich gefährlich wird.

In that sense, I am not a prophet either; I cannot assess at what point it really becomes dangerous.

Sein Lehrstuhl ist der Lehrstuhl für Common Law, also grob gesagt angloamerikanisches Recht mit einem Schwerpunkt auf dem Verfassungsrecht.

His chair is the Chair of Common Law, broadly speaking Anglo-American law with a focus on constitutional law.

Fettke sagt,

Die Tatsache, dass wir jetzt ein Verfahren im US-Supreme Court haben, wo es um Insurrection geht,

Der Rechtsstaat funktioniert in dem Sinne schon.

Sie sehen ja, die Verfahren laufen gegen Trump, strafrechtliche Verfahren.

You see, the proceedings are ongoing against Trump, criminal proceedings.

Eins ist jetzt im Moment in New York im Gange.

One is currently in progress in New York.

Drei weitere warten darauf, loszulegen.

Und da sehen...

Das ist eigentlich ein Beispiel.

Drei Strafverfahren stehen aus.

Man besorgt sich darum, dass der Präsident ein Trump sein könnte nächstes Jahr

Ob er die Wahl gewinnt, ist eine Frage.

Wenn er die Wahl gewinnt und es unternimmt, wird der Versuch gestartet, ihn daran zu hindern.

If he wins the election and takes action, an attempt will be made to prevent him from doing so.

Können die Gerichte dann angerufen werden?

Can the courts then be called upon?

Dann schreiten sie ein gegen einen solchen Versuch, sich selbst zu immunisieren gegen Strafverfahren als Präsident.

Then they intervene against such an attempt to immunize oneself from criminal proceedings as president.

Und das sind alles Unwägbarkeiten, die noch in der Zukunft liegen.

And those are all uncertainties that lie in the future.

Auch durch eine schwierige Gemengelage.

Kann er sich zum Beispiel selbst ein Pardon sprechen?

Can he, for example, grant himself a pardon?

Er hat ja das Recht, Straftäter dann auch zu begnadigen.

He does have the right to pardon offenders.

Da war eine Diskussion, ob ein Präsident sich selbst begnadigen kann.

There was a discussion about whether a president can pardon himself.

Mit Blick auf Straftaten, die vielleicht nach seiner Amtszeit aufkommen.

In view of crimes that may arise after his term in office.

Und wie weit das dann gelten würde.

And how far that would apply.

Da sehen Sie schon, der Rechtsstaat hat ein Problem.

There you can see, the rule of law has a problem.

Und das Vertrauen in die USA als Rechtsstaat hat Schaden genommen.

And trust in the USA as a rule of law has been damaged.

Aber bis zu einer Frage...

Wenn die Frage nicht tatsächlich positiv beantwortet wird, ja, der Präsident kann sich selbst begnadigen,
