Und für Geflüchtete, die eine Abschiebung fürchten müssen, ist es oft die letzte Hoffnung.

And for refugees who fear deportation, it is often the last hope.

Kirchenasyl.

Church asylum.

Bevor ich gleich ausführlich darüber spreche, klärt mein Kollege Manuel Klaas Hörster auf, was das eigentlich ist.

Before I go into detail about it shortly, my colleague Manuel Klaas Hörster will clarify what it actually is.

Kirchenasyl bedeutet heute, dass eine religiöse Gemeinde Menschen vorübergehend aufnimmt, die abgeschoben würden,

Church asylum today means that a religious community temporarily takes in people who would be deported.

She is the chair of the Federal Working Group on Asylum in the Church and a pastor.

Wir haben es gerade gehört, Tradition des Kirchenasyls, ja, einen rechtlichen Rahmen wie ein Gesetz oder ähnliches, das gibt es nicht.

We just heard it, the tradition of church asylum, yes, there is no legal framework like a law or something similar.

Worauf berufen sich denn Gemeinden überhaupt beim Thema Kirchenasyl?

What do communities rely on when it comes to the issue of church asylum?

Im Grunde berufen sich Kirchengemeinden darauf, dass es Situationen gibt, wo sie als Christinnen und Christen das Gefühl haben,

Basically, church communities rely on the fact that there are situations where they, as Christians, feel that

hier besteht die Gefahr, dass etwas geschieht, was nicht hinzunehmen ist,

there is a danger that something will happen that cannot be tolerated,

dass durch staatliches Handeln Menschen in Lebensgefahr geraten oder ihre Menschenwürde so verletzt wird,

that through governmental actions, people are put in life-threatening situations or their human dignity is so violated,

dass die Kirchengemeinde sagt, bitte, lieber Staat, schau hier noch einmal ganz genau auf diese Situation.

that the church congregation says, please, dear state, take a close look at this situation again.

Wir denken, das kann so nicht sein.

We think that can't be the case.

Es ist also vom Grunde her eine Gewissensentscheidung der Kirchengemeinde,

Anfang der Woche hat eine Korrektivrecherche gezeigt,

dass Ausländerbehörden immer mehr Schutzsuchende aus solchen Kirchenasylen abschieben.

Bis zum Jahr 2022 wurde das Kirchenasyl also so gut wie nie gebrochen von den Ausländerbehörden

Until the year 2022, church asylum was almost never violated by the immigration authorities.

und allein im Jahr 2023 waren es dann sieben Fälle.

Wenn wir das jetzt einmal vergleichen, bundesweit 594 Kirchenasyle,

Wie viel wurde aus dem Kirchenasyl geschoben? Ist das viel?

Nun, in den letzten Monaten, besonders natürlich in den vergangenen zwei Wochen,

ist ja die Diskussion um Flüchtlinge beziehungsweise um die Abschiebung von Geflüchteten ein ganz großes Thema.

The discussion about refugees or the deportation of refugees is indeed a very big topic.

Und Politik und Behörden stehen enorm unter Druck, mehr Menschen abzuschieben.

And politics and authorities are under immense pressure to deport more people.

Und unser Eindruck ist, dieser Druck macht dann auch vor Kirchenasylen nicht Halt.

And our impression is that this pressure does not stop at church asylums either.

Und sieben Fälle, das hört sich erstmal nach keiner,

And seven cases, that doesn't sound like any at first.

einer sehr großen Zahl an, aber die Verunsicherung, die diese sieben Fälle ausgelöst haben,

a very large number, but the uncertainty caused by these seven cases,

die ist enorm, bei Gemeinden natürlich.

It is enormous, especially among municipalities, of course.

Und bei den Menschen im Kirchenasyl, die ja meist besonders vulnerable und häufig traumatisiert sind,

And with the people in church asylum, who are often particularly vulnerable and frequently traumatized,

löst es ganz große Angst aus, dass dieser bisher als sicher erachtete Schutzraum nicht mehr sicher scheint.

It triggers a great fear that this shelter, which was previously considered safe, no longer seems safe.

Sie haben gesagt, da gibt es einen politischen Druck, der dahinter steht.

They said there is political pressure behind it.

Warum geht man da ausgerechnet zu Kirchen, zu religiösen Gemeinden,

Why do people specifically go to churches, to religious communities,

um dort abzuschieben?

to deport there?

Das frage ich mich manchmal auch.

I sometimes wonder that too.

Vielleicht hat es damit zu tun, Härte demonstrieren zu wollen.

Maybe it has to do with wanting to demonstrate toughness.

Vielleicht hat es damit zu tun, dass natürlich Menschen im Kirchenasyl ganz sicher dort anzutreffen sind.

Maybe it has to do with the fact that, of course, people are certainly to be found in church asylum.

Also vielleicht glaubt man, diese Abschiebungen lassen sich dann leichter durchführen.

So perhaps one believes that these deportations can be carried out more easily.

Ich bin besonders bestürzt darüber, weil schließlich jede Räumung, ob es eine oder sieben oder zehn,

I am especially upset about it, because after all, every eviction, whether it is one or seven or ten,

und jeder Versuch einer Räumung aus einem Kirchenasyl ein Bruch der staatlichen Zusage ist,

and any attempt to evict from a church asylum is a breach of the state's commitment,

Was heißt denn Härtefall in der Praxis?

What does hardship case mean in practice?

Also was sind das für Menschen, die dann von Kirchen aufgenommen werden?

So who are these people that are then taken in by churches?

Jede Kirchengemeinde entscheidet ja erst einmal eigenständig über die Gewährung eines Kirchenasyls.

Each church congregation initially decides independently on the granting of church asylum.

Und wenn das Kirchenasyl gewährt ist, dann begründen wir dem Bundesamt für Migration und Flüchtlinge

And when the church asylum is granted, we will justify it to the Federal Office for Migration and Refugees.

gegenüber dieses Kirchenasyl mit einem sogenannten Härtefall-Dossier.

opposite this church asylum with a so-called hardship dossier.

Das heißt, wir stellen dar, warum wir diese geplante Abschiebung für eine Verletzung der Menschenrechte

This means we explain why we consider this planned deportation a violation of human rights.

oder eine nicht zumutbare Härte halten.

Und diese Härten, die können dann zum Beispiel bestehen in schweren Krankheiten,

die im Zielland nicht gut behandelt würden.

Manchmal sind an solche Härtefall-Dossiers wirklich seitenlange klinische Gutachten angeheftet.

Sometimes, lengthy clinical reports are really attached to such hardship case files.

Manchmal sind es auch drohende Familientrennungen bei einer Abschiebung.

Sometimes it is also threatening family separations in the case of deportation.

Und leider gibt es oft Fälle von in Europa erlittener Gewalt.

And unfortunately, there are often cases of violence suffered in Europe.

Das BAMF sagt ja demgegenüber, wir prüfen solche Härtefälle.

The BAMF, on the other hand, says that we review such hardship cases.

Und in nur einem Prozent der Fälle ist laut Ansicht des BAMFs auch wirklich nur ein Härtefall,

And in just one percent of cases, according to the BAMF's view, there is really only a hardship case.

da ist es eigentlich sozusagen an Sie oder an Kirchen mehr so der Vorwurf,

Zu Beginn der sogenannten Vereinbarung 2015-16 war es so,

Mir ist tatsächlich eine Situation nach wie vor sehr präsent.

I still have a situation very vividly in my mind.

Ich komme ja, wie gesagt, aus Norddeutschland.

As I said, I come from Northern Germany.

Und wir hatten bei uns im Norden eine afghanische Familie,

And we had an Afghan family with us in the north,

Mutter, Vater und vier Kinder im Kirchenasyl.

Mother, father, and four children in church asylum.

Die Frau ist eine bekannte Frauenrechtlerin und Journalistin.

The woman is a well-known women's rights activist and journalist.

Das Leben der Familie war also in Afghanistan wirklich hoch gefährdet.

The life of the family was indeed highly endangered in Afghanistan.

Und die Vorgeschichte war, dass deshalb die Bundesrepublik Deutschland

And the background was that therefore the Federal Republic of Germany

dieser Familie bereits eine Aufnahmezusage gegeben hatte.

had already given this family a promise of admission.

Dann aber dauerte die Visumserteilung total lange.

But then the visa issuance took a really long time.

Die Lebensgefahr bestand aber fort.

The danger to life, however, remained.

Und die Familie musste ohne Visum sich auf die Flucht begeben.

And the family had to flee without a visa.

Und als sie dann in Deutschland ankamen,

And when they arrived in Germany,

war keine Rede mehr von der Aufnahmezusage.

There was no longer any mention of the acceptance promise.

Sie sollten zurück in das Europäische Erstein.

You should return to the European First.

Und wir haben also mit dem Kirchenasyl

And we have therefore been granted church asylum.

Deutschland an sein gemachtes Versprechen erinnern wollen.

Leider wurde aber vom Bundesamt auch dieser Härtefall abgelehnt.

Unfortunately, this hardship case was also rejected by the Federal Office.

Und dann kam drei Tage vor Weihnachten letzten Jahres

Und die Familie war völlig außer sich, drohte mit Suizid,

Und nach diesem Räumungsversuch

And after this eviction attempt

hat es ganz viele Gespräche gegeben zwischen Kirche und Behörden.

There have been many discussions between the church and the authorities.

Und alle waren sich eigentlich einig,

And everyone was actually in agreement,

dass solche Situationen und solche Bilder niemand möchte.

that no one wants such situations and such images.

Aber wie wir wieder zurückkommen zu der Akzeptanz von Kirchenasyl

But how do we return to the acceptance of church asylum?

und zu dem eigentlich verabredeten gemeinsamen Suchen

and to the actually agreed joint search

nach guten humanitären Lösungen,

after good humanitarian solutions,

das ist leider noch nicht klar.

That's unfortunately still not clear.

Übrigens hat die afghanische Familie nach Ende des Kirchenasyls

ganz schnell ihren Bescheid bekommen.

Und sie wurden als politische Flüchtlinge anerkannt.

Kirchen haben Angst, dass immer mehr solche Fälle hinzukommen,

eben weil es anscheinend einen hohen politischen Druck gibt zu handeln,

Jetzt läuft seit circa einer Woche eine Petition an die Bundesinnenministerin Nancy Faeser

A petition to the Federal Minister of the Interior, Nancy Faeser, has been running for about a week now.

mit der Forderung, Kirchenasyle-Verräumungen zu schließen.

with the demand to end church asylum removals.

Die Petitionen haben mittlerweile über 55.000 Menschen unterschrieben.

Glauben Sie, dass eine solche Petition was bringen wird?

Also es macht uns Mut, dass die Petitionen in der ersten Woche

Und sie läuft ja auch noch eine Weile.

Und von daher denke ich, je mehr Menschen sie zeichnen,

Und es geht in dieser Petition ja erst einmal um den Schutz

Aber dahinter steht,

dass die Menschen, die in der Kirchenasyl-Verräumung sind,

für uns noch etwas viel Größeres.

Und für mich geht es tatsächlich darum,

was für eine Gesellschaft wir sein wollen.

what kind of society we want to be.

Nämlich eine, die geprägt ist von Achtsamkeit füreinander.

Namely one that is characterized by mindfulness towards each other.

Oder eine, die sich gerade macht,

Or one that is just getting ready,

wenn andere in ihrer Würde verletzt werden.

when others are harmed in their dignity.

Oder eine, die weiß,

Or one who knows,

dass auch im besten Rechtsstaat Fehler gemacht werden.

that mistakes are also made in the best legal state.

Ich glaube, wir verlieren nichts,

I believe we are losing nothing,

wenn wir unsere Humanität bewahren.

if we preserve our humanity.

Im Gegenteil.

On the contrary.

Und wir verlieren aber viel,

And we lose a lot,

wenn wir Räume der Menschlichkeit oder Schutzräume

when we create spaces of humanity or safe spaces

oder das Kirchenasyl opfern.

das verstehen mehr Menschen in Deutschland,
