副業の続きということで第2弾やっていきたいなと思います

Since we're continuing with the side job, I would like to dive into the second installment.

しばらく副業シリーズ続きそうですけども

It seems that the side job series will continue for a while.

ちょっと前回のおさらいからさっといきましょうか

Shall we quickly go over what we covered last time?

そうですね前回のおさらいで副業をするとき

That's right, in the review from last time, when doing side jobs...

させるかどうかを決めるときに会社がやるべきことが5つあるようなところで

It seems that there are five things a company should do when deciding whether to allow it or not.

前回3つ話させてもらったんですけど

1つ目が副業を認めるかどうかを決めるということですね

The first point is deciding whether to allow side jobs.

そりゃそうですよねということと

あとは認める方式を決めるというところで

許可制とかそういう話をさせてもらう

副業を始めるって決まったら

これやってほしいことが1個ありまして

まずプロセスとしてはまず1個目が

First, the process starts with the first one.

従業員に副業許可申請書というのを出させるんですね

You make employees submit a side job permission application.

私は何々でこういう仕事をやりたいですというところで

I want to do this kind of work in that field.

お伺いをされるような形にしてもらって

Please make it in a way that I can inquire.

会社がいいですよという形になったら

If the company agrees, then...

初めて相談の

For the first consultation

交渉ごとに乗れるというようなイメージなんです

It gives the impression that one can engage in negotiations.

今度次は例えば総務とか人事と

Next time, for example, in general affairs or human resources.

副業をやりたい人と話をして

Talk to people who want to do side jobs.

そこでどういう働き方で働くかというところで

So, it's about what kind of working style to adopt.

副業合意書副業権業もあるんですけど

There is also a side business agreement, but there are rights related to side businesses.

副業に関する合意書みたいなものを

Something like an agreement regarding side jobs.

会社と従業員で作るというのが一般的な流れです

It is common for the company and the employees to create it together.

なぜこれがいるかというと

要は個別具体的に細かく取り決めておかないと

In short, if you don't make specific and detailed arrangements,

働き先がみんな違うわけなので

というようなところから

本当に個別契約に近い形になるんですけど

それを決めるということですね

例えば副業先は週3回までしか働かないとか

副業先では何時から何時までで

時間外労働してもいいのかしてもいけないのかとか

If that happens, from what time to what time?

何時までにするのかっていうのを決めるんですよ

でこういう話はしていいとかしちゃいけないとか

絶対にしちゃいけないとか

それはあの協業基地とかの観点からとかですか

で反対に合意書に違反したら

副業を取り消しますよみたいな

で何でこんなこと言ってるかっていうと

一つが過重労働っていうところで

普通に所定労働時間働きまして

そうすると副業先っていうのは

完全に法律の時間外で働いてるわけなんで

そこで80時間以上働きましたとか

"I worked there for over 80 hours."

副業先プラス自社の残業を合わせて

Combining overtime from the side job with our company's overtime.

80時間超えました100時間超えましたって言って

"I've exceeded 80 hours, I've exceeded 100 hours."

もう倒れてしまった時は

If you have already collapsed.

安全配慮義務っていうのを

The duty of ensuring safety.

基本的に副業先と連携して

Basically, in collaboration with my side job.

こういうような形になるんですよね

It becomes something like this.

その場合は連帯なんですね

In that case, it's solidarity, isn't it?

基本は連帯だし

The foundation is solidarity.

反対に知らなかったじゃ済まされないんですよね

止められる仕組みを作っておかないといけないよ

っていうのがポイントですね

ちゃんと労働を管理しなきゃいけないって感じですね

It feels like we really have to manage our work properly.

すごい平たく言うと

未払い残業の問題がありまして

週20時間以上働くと

社会保険に加入しなきゃいけない

両方入って接班しなきゃいけない

というルールがあります

社会保険の会社負担分を

The company's share of social insurance.

それぞれ受けようと

あと給与で安分するって形なんです

It's a way to distribute it based on the salary.

給与の割合で安分するというルールになってます

そうすると相手が入っているかどうか知らないと

手続きしたらできないので

作らなきゃいけないので

そこで副業規定みたいなのを作成するんです

So, I'm going to create some kind of side job regulations.

就業職の一部ですよね

It's part of the job, isn't it?

副業規定ね

It's about the side job policy.

ポイントは

The point is

目的とか

Purpose or something like that.

適用範囲みたいな感じで

Like a scope of application.

どこの社員に適用しますよと

It will be applied to employees from which company.

あと許可のプロセスルールですよね

あと一般的な留意事項とか

あとは時間管理の方法の一般的なパターンを入れておくということと

Additionally, it involves incorporating general patterns of time management methods.

あと一番大事なのは禁止事項ですね

And the most important thing is the prohibited items, right?

で禁止事項を破ったら

If you break the prohibited items.

例えば合意書を作ったんだけど

For example, I created an agreement.

合意書を破ったら取り消しますよとか

If you break the agreement, I will cancel it.

こういうような事案

Such incidents like this.

例えば仕事中に寝てたと

For example, you were sleeping during work.

これが2回も注意されたら

副業を禁止します

とかいう形で

In that form or something like that.

禁止事項も入れておくっていうのは大事かなという風に思っています
