Po wejściu w życie nowej ustawy deweloperskiej jednym z najczęstszych problemów jakie się pojawiają jest rozstrzygnięcie zakresu podmiotowego i przedmiotowego ustawy, czyli tak naprawdę kto i kiedy powinien ją stosować.

After the new developers' law comes into force, one of the most common problems that arise is determining the subject and object scope of the law, meaning who and when should apply it.

Nowa ustawa deweloperska bowiem rozszerza zakres przedmiotowy i podmiotowy dotychczasowych przepisów stosowanych do sprzedaży lokali mieszkalnych i domów budowanych w ramach przedsięwzięć deweloperskich oraz modyfikuje treść umowy deweloperskiej oraz ustawowe prawo.

The new developers' law expands the subject and personal scope of the existing regulations applied to the sale of residential premises and houses built as part of development projects, and modifies the content of the development agreement and statutory rights.

It is a fact that we previously applied the law in situations where the developer committed to constructing a building, establishing separate ownership of a residential unit within it, and transferring ownership of that unit or single-family house to the buyer.

Zatem wyłącznie do zawierania umów dotyczących sprzedaży lokali mieszkalnych bądź budynków, domów jednorodzinnych będących w trakcie budowy.

Natomiast w przypadku sprzedaży gotowych lokali ustawa nie miała zasadności.

Przepisy nowej ustawy mają zastosowanie do każdej umowy zawieranej przez dewelopera z nabywcą, na podstawie której deweloper zobowiązuje się do ustanowienia praw wynikających z umowy deweloperskiej i w tym także do umów zawieranych już po zakończeniu budowy.

The provisions of the new law apply to every agreement made by the developer with the buyer, under which the developer undertakes to establish rights arising from the development agreement, including agreements made after the completion of construction.

W pewnym zakresie stosujemy nową ustawę deweloperską do umów zawartych między nabywcą a deweloperem, w których deweloper zobowiązuje się do wybudowania budynku oraz ustanowienia odrębnej własności.

I co istotne, sama ustawa ma zastosowanie wtedy, gdy nabywca lokalu bądź domu jednorodzinnego nabywa tą nieruchomość na cele niezwiązane z prowadzoną działalnością gospodarczą.

And importantly, the law applies when the buyer of the flat or single-family house acquires the property for purposes not related to business activities.
