Episódio #3 -O que é a NCM?

Bom, o tema de hoje é NCM, que significa Nomenclatura Comum do Mercosul.

Well, today's topic is NCM, which stands for Common Nomenclature of Mercosur.

Essa pequena palavra tem grande peso para o comércio internacional.

This small word carries great weight in international trade.

Então, eu vou começar dividindo o episódio de hoje em duas partes.

So, I will start by dividing today’s episode into two parts.

Primeiro, o conceito de NCM e, segundo, a aplicabilidade, como que funciona na prática uma NCM no comércio internacional.

First, the concept of NCM, and second, its applicability, how an NCM works in practice in international trade.

Então, como eu falei para vocês, NCM significa Nomenclatura Comum do Mercosul.

So, as I told you, NCM stands for Common Nomenclature of Mercosur.

Ela é uma nomenclatura aceita desde 1995 pelo Brasil, pela Argentina, pelo Paraguai e também pelo Uruguai.

It is a nomenclature accepted since 1995 by Brazil, Argentina, Paraguay, and also Uruguay.

Essa nomenclatura diz respeito a um código de rastreio dos produtos importados.

This nomenclature refers to a tracking code for imported products.

Então, é só a gente imaginar.

So, we just need to imagine.

Quando o produto é importado, ele tem que conter uma NCM, ou seja, ele tem que ter um número de série,

When the product is imported, it must contain an NCM, that is, it must have a serial number.

vamos colocar assim para facilitar o entendimento, que rastreia dois objetivos.

Let's put it this way to make it easier to understand, it tracks two objectives.

Primeiro, o objetivo administrativo e, segundo, o objetivo tributário.

First, the administrative objective and, second, the tax objective.

Então, o objetivo administrativo, ele diz respeito ao que a gente acabou de conversar,

So, the administrative objective concerns what we just talked about,

a qual que é o órgão anuente que vai autorizar ou não autorizar a entrada do produto no país.

which is the approving body that will authorize or not authorize the entry of the product into the country.

E o objetivo tributário é a atuação da aduana brasileira.

And the tax objective is the operation of the Brazilian customs.

Então, aquele produto, qual que é a carga de impostos que serão cobrados naquele produto?

So, that product, what is the tax burden that will be charged on that product?

Agora que vocês já sabem o conceito de NCM, qual que é a importância no mercado internacional,

Now that you already know the concept of NCM, what is its importance in the international market?

ou melhor, no desembarato aduaneiro aqui no Brasil?

or rather, in the customs clearance here in Brazil?

Uma NCM, ela traz consigo características administrativas e tributárias.

An NCM carries with it administrative and tax characteristics.

Logo, se eu erro uma NCM, eu recolho impostos errados

So, if I make a mistake with an NCM, I collect the wrong taxes.

e eu coloco ela para anuência de um órgão regulador, de um órgão anuente totalmente divergente.

And I submit it for approval to a regulatory body, to a completely divergent approving body.

Isso é muito prejudicial no comércio nacional.

This is very harmful to domestic trade.

Então, para vocês terem noção, quando a gente erra uma NCM,

So, to give you an idea, when we make a mistake with an NCM,

a gente não consegue realizar o desembarato da mercadoria até a sua correção.

We cannot proceed with the unloading of the goods until their correction is made.

E essa correção, ela vem com um presente negativo, um presente de grego.

And this correction comes with a negative gift, a gift from the Greeks.

Ela vem com uma multa.

She comes with a fine.

Então, a multa mínima de NCM errada, ela começa em 5 mil reais.

So, the minimum fine for incorrect NCM starts at 5 thousand reais.

Fora os outros contratempos que causa, porque se vai atrasar, se eu erro uma NCM,

Besides the other setbacks it causes, because it will delay, if I make a mistake with an NCM,

para no porto até alterar essa NCM, que leva ali de...

to the port until changing this NCM, which takes there from...

6 a 7 dias, eu estou pagando armazenagem e eu também estou pagando demurrage,

6 to 7 days, I am paying for storage and I am also paying for demurrage.
