El derecho laboral, yo digo que es el derecho de la vida, ¿no?
Labor law, I say it is the right to life, right?
Porque en esta sociedad de libre empresa capitalista en que vivimos,
Because in this capitalist free enterprise society in which we live,
todo se compra con dinero.
Everything is purchased with money.
La vivienda, la vestimenta, el recreo, la transportación,
Housing, clothing, recreation, transportation.
todo lo que hacemos en nuestra vida lo compramos con la alimentación.
Everything we do in our life we buy with food.
Y para tener ese dinero necesario, en ausencia de que uno herede millones de dólares
And to have that necessary money, in the absence of inheriting millions of dollars.
o haga un capital o tenga suerte en la loto, pues todos tenemos que trabajar.

Por eso es que el derecho laboral implanta,

We work to live, we don't live to work, right?
Y por eso el derecho laboral es tan importante también para crear una clase media.
And that is why labor law is also so important for creating a middle class.

O sea que tiene que haber cierta reglamentación, no excesiva reglamentación,

pero tiene que haber reglamentación laboral para que la gente pueda sostenerse con su trabajo
But there has to be labor regulations so that people can sustain themselves with their work.
y pueda seguir progresando y así sucesivamente las nuevas generaciones que van viniendo
and can continue to progress, and so on for the new generations that are coming.

Yo creo mucho en el trabajo, creo mucho en la ocupación.
I believe a lot in work, I believe a lot in being busy.
Hay tres conceptos.
There are three concepts.
Está el trabajo, está el estudio,
There is work, there is study,
está el trabajo, está el trabajo, está el estudio,
there is the work, there is the work, there is the study,
y está la ocupación.
and there is the occupation.
Hay gente que ni trabajan ni estudian, pero están ocupados.
There are people who neither work nor study, but they are busy.
Pero hay otros que si no trabajan y no estudian, no tienen una agenda de vida.
But there are others who, if they do not work and do not study, do not have a life agenda.
Y eso es un detonante para conducta antisocial.
And that is a trigger for antisocial behavior.
Entonces está probado que una sociedad que tiene mucho empleo,
Then it is proven that a society that has a lot of employment,
tiene menos criminalidad y tiene menos problemas sociales.
It has less crime and has fewer social problems.
Porque la gente tiene una rutina sana de vida, ¿no?
Because people have a healthy life routine, right?
Tú te levantas por la mañana.
You get up in the morning.
Tienes una rutina para ir al trabajo.
You have a routine for going to work.
Allí estás con los compañeros y compañeras de trabajo, almuerza.
There you are with your coworkers, have lunch.
En el trabajo tradicional, ¿no?
In traditional work, right?
Porque hay otros trabajos.
Because there are other jobs.
Regresas a tu casa por la tarde.
You return home in the afternoon.
Estás con tu familia o con tu compañero o compañera
Are you with your family or with your partner?
para el otro día volver a trabajar.
for the other day to go back to work.
Eso te crea una rutina buena de vida que te aleja del alcohol, de las drogas, una serie.
That creates a good life routine that keeps you away from alcohol, drugs, and a series of other things.
Hay un montón de cuestiones sociales que se combaten,
There are a lot of social issues that are being addressed,
que como mejor tú las combates es con un trabajo.

O un empleo.
Or a job.
Y por eso es que yo digo que el derecho laboral es tan importante.
And that's why I say that labor law is so important.

¿Y qué es de estas pocas cosas que nos quedan,

En el 68, don Juan B. Aponte, yo creo que fue su tesis doctoral

Él vino a Puerto Rico con esta idea de crear este seguro público

Históricamente, las personas que están aseguradas,

y eso no ha cambiado mucho, es el 20% de la población.

Él se percató de eso, que no ha cambiado,
He realized that it hasn't changed.

Como nota marginal, con el 68 o 70,

morían 500 personas más o menos en accidentes de tránsito.

Ahora mismo mueren menos, con más carros y más personas.
Right now, fewer people are dying, with more cars and more people.
Eso se debe en gran medida a los avances tecnológicos
This is largely due to technological advancements.
en la fabricación de los automóviles,
in the manufacturing of automobiles,
el cinturón de seguridad, las bolsas de aire,
the seatbelt, the airbags,
y en el caso de Puerto Rico, tanto tapón que nos impide ir ligero.
And in the case of Puerto Rico, so much traffic that prevents us from going quickly.
Entonces, pues, don Juan se dio cuenta de eso.
So, then, Don Juan realized that.
La industria de seguro, y eso yo lo relato en el libro,
The insurance industry, and I recount that in the book,
atacó esa iniciativa de don Juan Bea Ponte de crear la ACA.
he attacked that initiative of Don Juan Bea Ponte to create the ACA.
Decían que eso iba a representar la quiebra de Puerto Rico.
They said that this would represent the bankruptcy of Puerto Rico.
Increíblemente, el gobierno quebró y la ACA sigue.
Incredibly, the government went bankrupt and the ACA continues.
O sea que un seguro, y yo discuto las bases actuariales,
So an insurance, and I discuss the actuarial bases,
un seguro básicamente es grandes números.
An insurance is basically large numbers.
Primero, tú proyectas un número de pérdidas que vas a tener que pagar
First, you project a number of losses that you will have to pay.
para determinada conducta o evento, ¿no?
for a specific behavior or event, right?
De ahí tú sacas la prima que vas a cobrar en el seguro.
From there you determine the premium you are going to collect on the insurance.
Le añades a esa prima los gastos administrativos
You add the administrative costs to that bonus.
y un por ciento también para inversiones.
and one percent also for investments.
De ahí se saca la prima que se va a cobrar en el seguro
From there, the premium that will be charged in the insurance is determined.
y se hace la reserva actuarial.
and the actuarial reserve is made.
Un seguro bien administrado con una buena reserva actuarial
A well-managed insurance with a good actuarial reserve.
no tiene por qué quebrar.
It doesn't have to break.
Y el mejor ejemplo es ACA,
And the best example is HERE,
que es un seguro que se hizo en el 68,
What is insurance that was done in 68?
que empezó en el 69, que por poco se cuelga,
that started in '69, that almost hanged itself,
porque del 68 al 69 se da el cambio del Partido Popular,
because from 68 to 69 there is a change in the Popular Party,
la hegemonía de 28 años que tuvo el gobierno,
the 28-year hegemony that the government had,
que gana don Luis Ferrer por pluralidad,
what Mr. Luis Ferrer earns by plurality,
por la cuestión del Partido del Pueblo,
for the issue of the People’s Party,
que le llevó 100.000 electores al Partido Popular.

Y la industria de seguro que habilió con don Luis Ferrer

Y ahí vino un líder obrero, Narciso Maldonado,

que era amigo de don Luis Ferrer,

y le hace la gestión de la reunión entre don Juan Bea Ponte y don Luis Ferrer.
and arranges the meeting between Mr. Juan Bea Ponte and Mr. Luis Ferrer.
Ahí don Juan le explica a don Luis Ferrer las bondades del proyecto
There, Don Juan explains to Don Luis Ferrer the virtues of the project.
y cómo se iba a resolver el problema social que había que resolver.
And how the social problem that needed to be solved was going to be resolved.
Don Luis Ferrer le dice, oye Juan, si esto es así, esto es un gran proyecto.
Don Luis Ferrer says to him, "Hey Juan, if this is the case, this is a great project."
Y don Juan le dice, pues sí, es así, y es un buen proyecto.
And Don Juan says to him, well yes, that's how it is, and it's a good project.
¿Y en qué consiste ese seguro?
And what does that insurance consist of?
La ACA básicamente cubre todos los accidentes de automóviles,
The ACA basically covers all car accidents,
los daños a la persona, no al vehículo.
the damages to the person, not to the vehicle.
Todas las heridas que tú tengas,
All the wounds that you have,
se rompen muchos huesos,
many bones break,
toda la enfermedad o eventos fisiológicos a causa de un accidente de tránsito,
all the illness or physiological events due to a traffic accident,
los cubre ACA.

Sin un centavo, si no le cobran un centavo a la persona,

Sin importar quién tiene culpa.

Por no fault insurance.

Ahí la ACA se economiza una cantidad de dinero increíble,

porque al tener un no fault insurance,
because by having a no fault insurance,
uno no está en los tribunales peleando la cobertura o no.
One is not in the courts fighting over coverage or not.
Aquí no importa quién tuvo la culpa,

lo importante es que esté asegurado,
the important thing is that it is insured,
que tenga una licencia válida, es un requisito,

que no esté en regateos en las carreteras,

Y una vez se dan esos requisitos,

fue uno de los que se benefició de eso,

que tuvo un accidente de tránsito y quedó muy mal.

Y así por el estilo,

han habido muchas personas que han tenido,

que han tenido que recurrir a la ACA,
that they have had to turn to the ACA,
saben las bondades de ese seguro.
They know the benefits of that insurance.
Y lo curioso, Frank,
And the curious thing, Frank,
es que la clave de esto es que es un seguro compulsorio
The key to this is that it is compulsory insurance.
y es una cantidad ínfima la que tú pagas en tu licencia.
And it is a minimal amount that you pay for your license.
No importa que tú tengas un Volkswagen o un Mercedes Benz,
It doesn't matter if you have a Volkswagen or a Mercedes Benz,
la cantidad es la misma.
the amount is the same.
35 dólares.

Acá hay un seguro parecido en Saskatchewan, en Canadá,

y otro en Quebec, también parecidos a la ACA.

Por supuesto, acá se adaptó a la sociología de Puerto Rico
Of course, here it was adapted to the sociology of Puerto Rico.
y a la economía de Puerto Rico,
and to the economy of Puerto Rico,
pero esos seguros cobran sobre 100 dólares.
But those insurances charge over 100 dollars.
Y aquí nosotros con 35 dólares.
And here we are with 35 dollars.
Por supuesto, hay que subirlo.
Of course, it needs to be uploaded.
Habrá que subirlo eventualmente porque ya no da.
It will have to be raised eventually because it can no longer support it.
Lo que pasa es que al principio hubo unas ganancias tan extraordinarias
What happens is that at first there were some extraordinary profits.
y la reserva creció muchísimo
and the reserve grew a lot
y ahora mismo la ACA se sostiene con la reserva
And right now the ACA is sustained by the reserve.
y parte de los 35 dólares y también el aumento en los autos.

O sea, en Puerto Rico hay 2 millones y medio de automóviles
In other words, there are 2.5 million cars in Puerto Rico.

Esto es lo más parecido al concepto de un país sobre ruedas.

Aquí vamos en carro para todos lados

Se han gastado 2 billones de dólares.
2 trillion dollars have been spent.
Más todo lo que cuesta mantener ese tren urbano,

que yo no sé quién hizo esas paradas,
I don't know who made those stops,
quién escogió la ruta,
who chose the route,
pero eso no va de ningún sitio a ningún sitio.
but that goes nowhere to nowhere.
No se usa.
It is not used.
La utilización es muy poca.
The usage is very low.
Con lo que se gastó en ese tren urbano,

que yo estoy seguro que hubo muchas cosas,

se hubiese podido hacer un tren de circunvalación de la isla

Pero eso está ahí y hay que seguir creciendo de forma inteligente.

luego de 8 años del gobierno de Pedro Rosselló,

que sabemos que fue un año,
that we know it was a year,
unas administraciones plagadas por eventos de corrupción.
administrations plagued by events of corruption.
Explícanos qué estaba sucediendo en las relaciones obreros patronales,
Explain to us what was happening in the employer-worker relations.
también particularmente que el gobierno de Pedro Rosselló
also particularly that the government of Pedro Rosselló
con el control de la legislatura en el Partido Nuevo
with control of the legislature in the New Party
habían hecho una supuesta reforma laboral.
they had made a supposed labor reform.
Sí, bueno, el gobierno de Pedro Rosselló esos 8 años,
Yes, well, the government of Pedro Rosselló during those 8 years,
ese gobierno como que adoptó la corrupción como forma de gobierno.
that government seemed to adopt corruption as a form of governance.
Siempre ha habido corrupción, pero limitada.
There has always been corruption, but limited.
Puerto Rico se caracterizaba por ser un gobierno limpio
Puerto Rico was characterized by being a clean government.
hasta que llegó Pedro Rosselló,
until Pedro Rosselló arrived,
que yo creo que mi opinión personal es que es una persona débil,
I believe that my personal opinion is that he/she is a weak person.
que no se atrevió a despedir gente y acusar gente,
who did not dare to fire people and accuse people,
pero eso es otro tema.

La cuestión es que Puerto Rico ha tenido unas buenas leyes laborales,
The issue is that Puerto Rico has had good labor laws,
yo entiendo que las leyes laborales y las leyes contributivas interactúan.
I understand that labor laws and tax laws interact.

a que todo el mundo aporte al gobierno de acuerdo a sus ingresos.

El derecho laboral en cierta medida reparte esa riqueza

no tengo vacaciones,

Básicamente las quejas eran contra las megatiendas

y los establecimientos de comida rápida

porque los pequeños comerciantes

no abusaban de la media jornada.

Ni las manufacturas,

que pagan mucho más que el salario mínimo,
that pay much more than the minimum wage,
con muchos mejores beneficios,

que fue atacada por el gobierno de Pedro Rosselló,

entonces cuando el estudio más rojo

there are 8000 jobs,
son buenos.
They are good.
Y yo les dije,
And I told them,

How many are full-time?
y cuántos a jornada parcial?
And how many are part-time?
Y me dijeron,
And they told me,
pues 60% a media jornada
Well, 60% part-time.

that they even had megastores for clients

O sea que uno no sabe de dónde vino esa idea.
So one doesn't know where that idea came from.
Pero la cuestión fue que eso a mí me indignó,
But the thing was that it outraged me,
porque estábamos enseñando a nuestros jóvenes
because we were teaching our youth
a trabajar cuatro horas,
to work four hours,
no les estábamos dando oportunidades de progresar,
we were not giving them opportunities to progress,
no tenían ni derechos a vacaciones ni por enfermedad.
They had neither rights to vacation nor to sick leave.
Era un incentivo.
It was an incentive.
Y un empleado a media jornada es casi un subempleo
And a part-time employee is almost underemployment.
cuando eso se riega demasiado por la sociedad.

Y eso a mí me indignó.

Y ahí empecé con la pelea con las megatiendas.
And that's when I started the fight with the megastores.

que más pequeños comerciantes representa,

se unió a mis esfuerzos

y estuvo de acuerdo con que se reglamentara

y se quitara esa ausencia de derechos

porque no hay que mencionarlas.
because they should not be mentioned.
Es bien fuerte porque ellos te dicen
It's very strong because they tell you.

It's not that I create many jobs.
y si tengo que dar muchos derechos
and if I have to give up many rights
pues tengo que crear menos empleo.
Well, I have to create fewer jobs.
Eso es una tontería porque es proporcional.
That's nonsense because it's proportional.
